Restrictions that may happen during the divorce process

People in Arizona who are going through a divorce should be aware that there might be restrictions on how they use money, their movements and even where they go with their children. While laws vary from state to state, there are some broad guidelines that should be followed. One divorce attorney was surprised to learn that in her own divorce, she had to pay her husband's health insurance for several months. During a divorce, the insurance situation between spouses must stay the same. The courts are mindful of the high cost of health care, and one spouse is not permitted to remove the other from an insurance plan before the divorce is finalized.

During her custody battle with Brad Pitt, Angelina Jolie was not permitted to simply take her children to London with her where she was filming. Courts are concerned about the possibility of children being taken out of the country because they might not be returned, but parents are not even supposed to leave the state with children without permission. Law enforcement could be involved if parents do not have an agreement in place that covers this.

People should also avoid moving money around or taking large sums from accounts. This could result in a requirement to reimburse the spouse.

If a spouse is misusing or hiding assets, a person might want to discuss this with an attorney. A parent may also want to talk to an attorney if there is a likelihood that the other parent might attempt a parental abduction. An attorney can be consulted prior to the divorce getting underway to talk about finances and other elements of how the divorce might proceed. For example, one party might be required to pay alimony to the other after the divorce.
